Kwara State High court has vacated an earlier injunction restraining the Speaker of Kwara State House of Assembly, from declaring the seat of Hon. Saheed Popoola, member, representing Ojomu/Balogun State Constituency vacant.
The interim injunction of March 30th granted by the Kwara State High Court, presided over by Hon. Justice I.A. Yusuf, restraining the Speaker of KWHA from declaring the seat of Popoola vacant as a result of his defection from the ruling APC to the SDP, have been vacated on Monday 11th April, 2022.
It would be recalled that the Kwara State House of Assembly in its letter to INEC had declared Popoola’s seat vacant in accordance with Section 109 (1)(g) of the 1999 Constitution of Nigeria as amended, stressing that his seat stands vacant since there is no division in the party on which platform he won the election in 2019.
With this development, the INEC is expected to conduct a by-election to fill the vacant position for the House of Assembly seat of Ojomu/Balogun State constituency.
